1. Introduction
These Terms & Conditions govern the supply of services by byKlash Ltd (“we”, “us”, or “our”) to clients (“you” or “the Client”).
By using our website or purchasing our services, you agree to these Terms.
Our Client Service Agreement, available at byklash.com/client-service-agreement, forms part of these Terms.
2. Services
byKlash Ltd provides services including, but not limited to:
- Website design and development
- Website hosting and maintenance
- Branding and graphic design
- Print design and production
- Digital consulting
- Website subscriptions and support plans
Service details will be defined in proposals, quotes, or agreements.
3. Quotes & Proposals
Quotes:
- Are valid for 30 days
- Are based on information provided by the client
- May change if project scope changes
Additional work outside the agreed scope may incur extra charges.
4. Website Subscription Services
We may offer monthly website subscription plans, which can include:
- Website design
- Hosting
- Updates
- Security maintenance
- Technical support
5. Minimum Contract Term
Website subscription services provided by byKlash Ltd are subject to a minimum contract term of 6 to 24 months, depending on the selected plan and agreement.
By proceeding with payment and onboarding, the Client agrees to the following:
- Monthly payments must continue for the duration of the agreed minimum term.
- Work may begin immediately following payment, onboarding completion, or written approval from the Client.
- Setup fees, onboarding fees, strategy fees, design fees, and completed work are non-refundable once work has commenced.
Cancellation Before Website Launch
If the Client cancels the project before the website has been launched or delivered, byKlash Ltd reserves the right to charge for:
- all work completed up to the cancellation date;
- any committed third-party costs, including hosting, domains, software, plugins, subscriptions, or production costs;
- and an early termination fee equal to 30% of the remaining minimum contract value.
Cancellation After Website Launch
If the Client cancels after the website has been launched, delivered, or made live, the remaining balance for the agreed minimum contract term shall become immediately payable.
After the minimum term has ended, subscriptions continue on a rolling monthly basis unless cancelled in writing with at least 30 days’ notice.
If applicable under consumer protection regulations, the Client expressly requests that services begin immediately and acknowledges that cancellation rights may be reduced or lost once work has commenced.
6. Payments
Payments may include:
- Project deposits
- Monthly subscriptions
- Maintenance or hosting fees
- Design or print production costs
Payments may be processed via:
- Stripe
- Bank transfer
- Other approved methods
7. Direct Debit & Recurring Payments
For subscription services, you authorise recurring billing.
Payments may be collected via:
- Direct Debit
- Subscription billing
- Automatic card payments
You must maintain valid payment details at all times.
8. Late Payments
If payments are overdue, we may:
- Suspend hosting
- Suspend maintenance services
- Disable website access
- Charge late fees or interest (where permitted)
Services may resume once payment is received.
9. Client Responsibilities
You agree to:
- Provide accurate information
- Supply content when required
- Ensure rights for any provided materials
- Respond promptly during project phases
Delays caused by the client may extend timelines.
10. Intellectual Property
Unless otherwise agreed:
- You own the final website/content after full payment
- byKlash retains ownership of internal tools and frameworks
- We may showcase completed work in our portfolio
11. Hosting & Maintenance
Where provided, services may include:
- Software updates
- Security updates
- Backups
- Monitoring
- Technical support
We aim for high availability but do not guarantee uninterrupted service.
12. Third-Party Services
Websites may rely on third-party services such as:
- Hosting providers
- Domain registrars
- Payment processors
- Plugins and tools
- Analytics platforms
We are not responsible for third-party failures.
13. Termination
Either party may terminate services with written notice.
If terminated during a minimum contract period:
- Termination fees may apply
Upon termination:
- Hosting may end
- Website files may be transferred if agreed
- Outstanding balances remain payable
14. Limitation of Liability
To the maximum extent permitted by law, byKlash Ltd is not liable for:
- Indirect or consequential losses
- Loss of business, revenue, or data
15. Governing Law
These Terms are governed by the laws of England and Wales.
16. Cookies
Our website uses cookies to improve functionality and analyse usage.

17. Acceptable Use
You must not use our services to:
- Distribute malware
- Engage in illegal activity
